Terms of Service

This Master Services Agreement and Terms of Service constitutes a legally binding contract between the subscribing entity ("Customer") and Potomac Operations Group LLC, a Virginia limited liability company ("POG"), governing all access to and use of the POG ERP platform ("Service").

1. Acceptance

By accessing or using the Service, Customer agrees to be legally bound by this Agreement.

2. Services

POG provides a cloud-based ERP platform with modules including POS, inventory, CRM, payroll, tax management, AI lead recovery (Katch Leads), smart scheduling, and other business tools.

3. Accounts

Customer is responsible for maintaining the confidentiality of login credentials and for all activities under their account.

4. Payment

Fees are billed monthly in advance via Stripe. All plans include a 14-day free trial. Your card is not charged until day 15. Fees are non-refundable except as required by law. No contracts — cancel anytime.

5. Data and Privacy

Customer retains ownership of all Customer Data. See our Privacy Policy for details on how data is collected, used, and protected.

6. Limitation of Liability

POG's total liability shall not exceed fees paid in the 12 months preceding the claim.

7. Termination

Either party may terminate with 30 days written notice. Customer Data is available for export for 30 days after termination.

8. Governing Law

Governed by the laws of the Commonwealth of Virginia. Disputes resolved through binding arbitration in Northern Virginia.

9. SMS Communications

By providing your phone number and checking the SMS consent box, you agree to receive automated text messages from Potomac Operations Group LLC related to our services, including but not limited to: missed call notifications, appointment reminders, follow-up messages, and service updates.

Message frequency: Up to 5 messages per interaction, no more than 10 per day. Messages are only sent between 9:00 AM and 9:00 PM Eastern Time.

Opt out: Reply STOP to any message at any time. You may also text UNSUBSCRIBE, CANCEL, QUIT, or END.

Opt back in: Reply START to re-subscribe after opting out.
